AureMarket is a marketplace, not a bank, broker, auctioneer of record, or escrow agent unless a listing expressly says otherwise. These Terms are not legal advice. If a court order or a signed agreement conflicts, that document controls.
By accessing or using AureMarket websites, apps, or services (the "Services"), creating an account, listing an item, or placing an order, you agree to these Terms of Service ("Terms"), our Privacy Policy, User Agreement, Fee Schedule, Payments Terms, and Buyer Protection Policy(collectively, the "Agreement"). If you do not agree, do not use the Services.
AureMarket provides a technology platform that allows users to offer, discover, and transact in goods. Except where we expressly state otherwise, AureMarket is not the buyer or seller of items listed by users. Title to goods passes between buyer and seller subject to the listing and applicable law. We do not take possession of items unless a specific program says so.
We may provide payment processing facilitation, shipping label tools, messaging, loyalty features (AureCircle), and dispute workflows. Those features do not make AureMarket a party to the underlying sales contract between users.
AureCircle welcome credit. AureMarket may offer new accounts a one-time credit of Aure Points; it is not offered at present. A credit already granted is granted once per account and is not withdrawn if the offer ends. Aure Points are a loyalty balance, not money: they have no cash value, are not redeemable for cash, are not transferable, and may only be applied on AureMarket as the AureCircle rules allow. Aure Points expire if no points are earned or spent on your account for 24 months in a row. We will email you at least 30 days before any points expire.
If you list items, you represent and warrant that:
AureMarket may remove listings, cancel transactions, withhold payouts, or limit features for policy, fraud, or legal risk.
Orders and bids are offers subject to availability and seller acceptance rules on the platform. Auction bids may be binding under listing rules. You agree to pay the purchase price and any applicable taxes shown at checkout. Shipping is included in the purchase price; checkout adds no shipping charge. Risk of loss for shipped goods transfers according to carrier terms and listing disclosures, unless Buyer Protection or law requires otherwise.
You may not list or transact in illegal items, stolen goods, counterfeit goods marketed as genuine, hazardous materials restricted by carriers, weapons or accessories restricted by law, adult content where prohibited, drugs and drug paraphernalia illegal under U.S. law, or other categories we ban in our Prohibited Items rules (as updated).
You may not:
Child safety. Zero tolerance for child sexual abuse material (CSAM), grooming, trafficking, or any sexual content involving minors (real or fictional). We will terminate accounts and report apparent CSAM to the National Center for Missing & Exploited Children (NCMEC) CyberTipline and/or law enforcement as required.
Other prohibited items and conduct are described in our policies (illegal goods, counterfeits, fraud, harassment, circumvention of fees, off-platform payment schemes designed to void Buyer Protection).
Seller fees and related charges are described in the Fee Schedule. Payment processing is described in Payments Terms. You are responsible for any taxes arising from your transactions (including sales, use, and income taxes), except taxes AureMarket is legally required to collect and remit. We may issue tax forms (e.g., Form 1099-K) when required by law.
Eligible transactions may be covered by our Buyer Protection Policy. Opening a case does not guarantee a refund. AureMarket may mediate or decide outcomes based on evidence, policy, and payment-network rules. Abuse of protection programs may result in account limits.
AureMarket branding, software, and site content (excluding user listings) are owned by AureMarket or its licensors. You receive a limited, non-exclusive, non-transferable license to use the Services as permitted by the Agreement.
By uploading listing content, you grant AureMarket a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content as needed to operate and promote the Services. You represent you have rights to grant this license.
DMCA: If you believe content infringes your copyright, send a notice that substantially complies with 17 U.S.C. §512 to our designated agent published on the Copyright / DMCA Policy. We may remove content and terminate repeat infringers in appropriate circumstances.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUREMARKET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or the quality, safety, or legality of user-listed items.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUREMARKET AND ITS AFFILIATES, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES, USER CONTENT, OR IN-PERSON MEETINGS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT OF FEES YOU PAID TO AUREMARKET IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.
You agree to defend, indemnify, and hold harmless AureMarket and its affiliates, members, managers, officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your listings, transactions, content, or violation of the Agreement or law.
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Exclusive venue is the state or federal courts located in Clark County, Nevada, subject to applicable consumer venue rights. Binding arbitration is not in force on this floor until a later posted amendment.
You may close your account as provided in product settings, subject to open orders and obligations. We may suspend or terminate access for breach, risk, or inactivity. Provisions that by nature should survive (including fees owed, IP licenses for past content use, disclaimers, limitations, indemnity, assumption of risk, and release) will survive termination.
We may modify these Terms by posting an updated version with a new effective date. Material changes will be highlighted where practical. Continued use after the effective date constitutes acceptance where allowed by law. If you do not agree, stop using the Services.
To protect the marketplace, we may require identity verification before certain actions — including selling, receiving payouts, increasing listing limits, recovering accounts, or processing high-value transactions. Verification may include government-issued ID checks and, where permitted by law and with appropriate notice/consent, biometric identifiers processed by our service providers (for example facial match to an ID document via Stripe Identity or a similar vendor).
Peer-to-peer trade involves inherent risk, including non-delivery, misdescribed goods, payment fraud, and risks of meeting in person. You assume those risks to the maximum extent permitted by law.
You acknowledge that there are risks in using an internet marketplace and in interacting with other users in person. We do not investigate or verify any user’s reputation, conduct, morality, criminal background, or information they submit (other than limited account tools we may already run). You are solely responsible for taking precautions when interacting with other users, especially when meeting a stranger in person. Other users may attempt to physically harm or defraud you. You are solely responsible for, and assume all risks related to, selling and buying through the Services, including all online and offline interactions with other users.
AureMeetup is an optional coordination tool: a suggested public venue class and a meet code that means “I’m here.” It is not a security service, escort, insurance policy, escrow, paid order, or law-enforcement supervision. We do not independently verify conditions at any venue, we do not monitor venues, and we do not warrant their safety or condition. Your use of any venue, and any dispute arising out of that use (including against a third party that hosts the venue), remains subject to this Section and Section 18. AureMarket does not charge, hold, or pay out Meetup handoffs. Cash at the venue is between the two of you.
Local laws apply. You must not use the Services for any illegal purpose, including trafficking or exploitation of minors. The Services are for users 18+ only. If you feel unsafe, leave and contact emergency services.
Because AureMarket is not the buyer or seller, you release AureMarket, its members, managers, officers, employees, and agents from claims, demands, and damages of every kind and nature, known and unknown (including claims of negligence), arising out of or related to disputes with other users, Meetup handoffs, and the acts or omissions of third parties, to the maximum extent permitted by law. This release does not limit liability for our own gross negligence, fraud, or intentional misconduct where applicable law does not allow that limit. If you are a California resident, you also waive California Civil Code § 1542, which says that a general release does not extend to claims that the releasing party does not know or suspect to exist at the time of the release and that, if known, would have materially affected the settlement.
If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or sale. These Terms are the entire agreement regarding the Services and supersede prior conflicting terms, except other policies expressly incorporated by reference.
